The value of intangible assets, and especially trade secrets, has risen substantially in the digital era and, at the same time, the theft of trade secrets (and the risk of theft) by company insiders and rogue employees has increased dramatically. This presentation will address these recent trends, including statistics and recent examples, and best practices for guarding against “outbound” theft by departing employees and limiting the risk of “inbound” misappropriation when a company recruits new employees from a competitor. The presentation will also address developments under the three-year-old federal statute, the Defend Trade Secrets Act, and differences between the federal statute and the Uniform Trade Secret Act
adopted by most states. The program will also address related developments
under the Computer Fraud and Abuse Act.

Mr. Bush concentrates his practice in the area of complex commercial litigation, with particular emphasis on misappropriation of trade secrets, information technology and software disputes, business torts, restrictive covenants and technology license disputes.
